Botswana Background Screening Guide

Botswana has just brought a rebuilt data protection framework into force, replacing an earlier law that never actually took effect — a useful reminder for employers that "a law exists" and "a law is enforced" are not always the same thing in this market.

National Identity Verification

Botswana’s national identity document is the Omang, required by law for all citizens aged 16 and older and valid for 10 years. It is issued through Botswana’s national civil registration system and displays the holder’s name, date and place of birth, identity number, and sex. The Omang is the standard identity reference for employment, banking, and government services.

Criminal Record Check

Botswana’s criminal-clearance process is handled by the Botswana Police Service, which verifies an applicant’s fingerprints against police records to confirm the presence or absence of a criminal record for employment, study, or other purposes. Typical turnaround time will be confirmed once Stodacom has processed sufficient volume in-market to report a reliable average.

Employment & Education Verification

Employment history verification is generally workable with established employers in Gaborone and other major centers. Education verification is reliable for accredited institutions; direct verification with the issuing institution remains the most reliable safeguard against fabricated or inflated credentials.

Data Protection & Consent

Botswana’s original Data Protection Act, 2018 was repealed before it ever fully came into effect, after its effective date was repeatedly extended by ministerial order. It has been replaced by the Data Protection Act, 2024, published in October 2024 and in force since 14 January 2025, overseen by the newly established Information and Data Protection Commission. Because enforcement infrastructure here is still new, employers should confirm current compliance expectations before initiating any screening involving candidates in Botswana rather than relying on older guidance referencing the 2018 Act.
